These Terms of Use (“Terms”) govern your access to and use of amigosicelandtours.com (the “Site”), operated by Amigos Iceland Tours ehf (“Amigos Iceland Tours,” “we,” “us”). By using the Site, you agree to these Terms and to our Privacy Policy and AI & Content Disclosure. If you do not agree, do not use the Site.

1. Information only, not an offer

Content on the Site is provided for general information about our business. Tour descriptions, itineraries, prices, and availability are subject to change and to confirmation in writing. Weather, road, safety, and supplier conditions may require changes to any itinerary. Booking, deposit, payment, cancellation, and refund terms are the ones stated in your booking confirmation, which control over anything on the Site.

2. No guarantee of results

We do not guarantee any particular outcome, savings, timeline, return on investment, approval, or result. Testimonials, reviews, case studies, and examples reflect individual experiences and are not a promise that you will get the same result. Statements about timing, pricing, or performance are estimates and may vary.

3. Accuracy of content

We work to keep the Site accurate and current, but it may contain typos, outdated information, or errors, including in content created or assisted by software tools. We may correct errors and change content at any time without notice. Nothing on the Site is legal, financial, tax, engineering, medical, insurance, or other professional advice. Consult a qualified professional for your specific situation.

4. Acceptable use and security

You agree not to, and not to help anyone else:

• Attempt to gain unauthorized access to the Site, its servers, admin areas, databases, or accounts, or probe, scan, or test the Site for vulnerabilities except as allowed in our security policy at /.well-known/security.txt.
• Upload or transmit malware, injected code, or harmful content, or interfere with or overload the Site (including denial-of-service attacks).
• Scrape, crawl, harvest, or copy content or data from the Site using bots or automated tools, or use Site content to train artificial-intelligence or machine-learning models, without our written permission. Ordinary search-engine indexing is allowed.
• Submit false, fraudulent, spam, or automated form entries, or impersonate any person or business.
• Reverse-engineer, frame, or mirror the Site, or remove any copyright or proprietary notice.
• Use the Site for any unlawful purpose or in violation of these Terms.

We may block access, remove submissions, preserve logs, and report suspected unlawful activity to law enforcement. Unauthorized access may violate Icelandic and other applicable computer-crime laws.

5. Intellectual property

The Site and its content, including text, design, logos, graphics, photos, videos, and code, are owned by or licensed to us and are protected by copyright, trademark, and other laws. You may view and print pages for personal, non-commercial use. Any other use requires our prior written permission.

Copyright concerns: if you believe content on the Site infringes your rights, email us with a description of the work, the page URL, your contact details, and a statement of good-faith belief. We will review and remove content where appropriate.

6. Your submissions

When you send us information, photos, reviews, or messages, you confirm that you have the right to share them and that they are accurate. You give us permission to use them to respond to you and provide our services. We will not publish your photos or reviews with your name without your permission.

8. Disclaimer of warranties

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. Warranties for any work, product, or service we provide, if any, are only those stated in your written contract, invoice, or receipt.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AMIGOS ICELAND TOURS AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT, INCLUDING RELIANCE ON ANY INFORMATION, IMAGE, OR ESTIMATE SHOWN ON THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED EUROS (€100). Some jurisdictions, including under mandatory EEA consumer law, do not allow certain limitations, so some of these may not apply to you. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for gross negligence or willful misconduct. This section does not limit liability that cannot be limited by law, and it does not change the terms of any signed contract for work or services.

10. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your violation of these Terms, or your violation of anyone else’s rights.

11. Disputes and governing law

These Terms are governed by the laws of Iceland, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us and try to resolve the dispute informally for at least 30 days. Any claim not resolved informally must be brought before the competent courts of Iceland. If you are a consumer living in the European Economic Area (EEA), the European Union, or the United Kingdom, nothing in these Terms takes away the protection of the mandatory consumer laws of your country of residence, and you may also bring a claim in the courts of that country where the law allows it.

12. Changes and termination

We may update these Terms at any time by posting a new version on this page. Continued use of the Site after changes means you accept them. We may suspend or end access to the Site for anyone who violates these Terms.

13. General

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and AI & Content Disclosure, are the entire agreement about use of the Site. Any signed contract, proposal, or booking confirmation for goods or services controls over these Terms for that transaction.
